    Wrong, time spent outside Canada while working for a Canadian company does not automatically counts for PR maintenance (2/5 years). That's for some exception situation like serving in the military etc.

    lol, please read what is written before jumping on your keyboard. I never said all jobs qualify for that. I specifically said he needs to check the requirements as not all jobs qualify.

    I Filed a case with NJ DOL and the outcome was pretty fast. It took 4 months to completely resolve the case. I spoke to DOL People yesterday and they said I will get all my money back.

    In your case go ahead and file a case with DOL. Once you file the case you will get a letter from DOL acknowledging your case. May be you can use this ack letter to send it to INS if any query arises.

    Before you even file a case tell your exemployer to pay all your money or else tell them that you will file case with DOL, INS. Still if they dont care then,,, go ahead and file the case....

    EndlessWait,
    nothing to worry about, it happened to me too,
    I opened an SR and two weeks later my wife got FP and I didn't, I thought I'll wait for a week or two but in vain. When I gave a follow-up call I came to know that FP was scheduled at my Attorney's place (I live in west coast and I was scheduled to attend FP at ASC in East coast) and the twist is my attorney never received it.on top of it when I asked the Rep about possibility of scheduling an FP at my place she advised me to file AR-11 form, at this point it was very clear to me that Rep doesn't have a clue on what she is talking about. the very next day I was luck to get hold of nice rep who said I quote
    " I don't understand why these people schedule FP at attorney�s location"
    he apologized and said he will open an SR to reschedule at my location and he assured me that this time it will be at my location, which I got in couple of weeks.

    Hope you will get your FP notice soon.

    A Memorandum of Marriage is different from the Certificate of Marriage.
    A Memorandum of Marriage is required to obtain a Marriage Certificate.

    Here is a sample (Schedule A) of the Memorandum of Marriage.
    You will need to obtain one from your local Marriage Court.

    I would say, the marriage certificate, a notarized copy of the Memorandum of Marriage from India, with some additional proof, like photos, invites', etc should suffice.

    stylepoet, I am no lawyer but I still think you can totally resolve this thing with a very good immigration lawyer instead of lobbying for a law change. If you wait around for legislative changes you may wind up waiting forever. Look at us. A multi-million dollar lobby like Compete America (which represent Fortune 500s like Microsoft, Google, Oracle, etc.) have been working towards some of the same goals we have been trying to achieve for the last 4-5 years, and either of us can hardly get anything done in Congress.

    Compared to the legal limbo we are in, your case really isn't that difficult. I am not trying to condescend you or anything but you my friend need to get a better lawyer if your current one is telling you that your case it stuck. It isn't! There are a lot of things you can do to manage your transition from E2 to EB5.

    One of the things you can do is convert your college-going daughter's status to F-1 (by getting a I-20) perhaps temporarily while you sell your business and apply for EB5. I know someone who was already in the US in May/June but his H1 didn't start till Oct and he didn't want to leave and re-enter becoz of embassy hassles back in his home country, so he applied for a Master's from a university and got an I-20 pretty quickly which helped him bridge the gap between June and Oct (he had to study full-time ofcourse to maintain status during that bridge-time). Another way to avoid missing school, is to do this over next summer when both of your daughters will be off for summer break...

    Once your kids turn 21 they will age out anyway. Meaning they will have to pursue their own green cards. So if you want them to get their green cards as your dependants you really need to move now. Take it from us. You really don't want to wait around for law changes!!

    Thanks for your input, Manderson. My family has been here for four years. We have two sons in England, one of whom is going through the E2 application process, and two daughters, one at University and one in high school. We would all like to stay permanently, but in order to raise the money for EB5, we would have to sell our business and that would put us in breach of our visa conditions.

    The half-centrury old E2 laws need to be updated to reflect the valuable economic input of investors. It is unrealistic to expect people to come here, settle their families and run successful businesses for a few years and then go home. Most decide they would like to stay but have no path to GC.

    We can't just leave the country and start again because of our daughters' education. Feels like catch 22, but I believe reform is the way forward.

    other than waisting my time (5min) in signing this petition (which by the way is another source of 'compelling stories'), is this bill worth the effort of IV core and IV members to support and follow-up, i.e. is it a good bill for us ? I have not read the bill itself. I am not very familiar with navigating the US legislation system. Do we have any idea what kind of support is out there for this bill ? Is this bill going to solve anything ? It is one thing to mandate fixing the system. The other thing is to actually do it. FBI recently canceled a big IT project that lasted a couple of years and is basically scrapped. Was that system supposed to fix the FBI namecheck backlog but failed ? Even if this bill passes and congress 'mandates' the FBI to fix the system, how long will it take to fix it ? They could spend another 3 years implementing a new system (personally I don't understand why - there is plenty of COTS tools out there to implement a Google-like system). But voting this bill could put a new urgency on the matter and inject new money in the effort.
    Or am I waisting everybody's time on this and does it not pertain to our cause (getting CIR passed) ?

    I had the same experience on Wednesday. Do not hang up, you will be connected to an IO after a while.

    I called (First time in last 4 months) to TSC using POJ method to check how they are trying to process cases. I know it was a futile attempt but wanted to try my luck regardless.

    Guess what? When you can't get through right away (which is never) you get put on hold in queue. Instead of background music you would get with any other wait in queue system - the message kept repeating every second - "Your estimated wait time is between 10-15 minutes"...

    It annoyed the heck out of me and I hung up rather than hearing the message over and over again.

    Since I have not called in past few months, I do not know if this is how it always worked or is this a recent change. As far as I recall, they did have background music which made it a little bearable to wait 10 minutes.

    1. I would like to believe that all visa numbers include the dependents etc .. since USCIS has the numbers.
    2. At the same time .. maybe 245i is kicking in .. else the priority dates would be different

    The only thing I'm not clear about is this:
    Is 245i only affecting eb3 and not eb2?

    And also from the answers it looks like, inspite of uscis making the numbers public .. it doesn't help us make a prediction

    1. AC21 - get it all done with new company ? Job title from Sr.Qa to SAP BI would it be a problem?

    If any RFE comes, new company should be able to support as per job description/title in Labor which they won't I believe.

    2. Temporary resignation and rejoining - is it really feasible?
    I don't think you need to resign something in particular.
    You can work with SAP company and when your date is becoming current move to QA Company and you should be good. Its like filing AC-21 to SAP company and again filing AC-21 to QA Company.

    I know lot of people do this who are working on EAD. Generally you know your date will be current in next year. So you can work for SAP untill June/july-2011 and then move back to QA Company before date becomes current.

    3. Stay with current company - try for contract positions even if it means that I have to stay long on bench. I have been already out since Aug.

    Your choice and lets wait for some Guru's answers.

    RFE for Dependent - To show the valid status from day of entery till we filed I 485

    One of the supporting document is I-94, but we gave at port of departure.

    We have the second I-94 which we received while coming back. Is this copy good enough or do we need to get the second copy.

    any body with similar experience please share your thoughts.

    US born citizens cannot deported. But naturalized citizen can be deported, if he obtained immigration (GC) by frudalent means (false documents, sham marriage, by cheating.. etc).

    Citizens of US cannot be deported. That is the LAW... But if that guy had a Green Card or any other visa, then he can be deported...

    I think what Asian means is that the stringent rule of 'Same kind of job' in AC21 makes AC21 usability very limited. If that condition is abolished, 485 is as good as GC in terms of job mobility.

    Unfortunately that doesn't have a lot of support since it defeats the purpose of labor certification.

    NO, u cannot apply, unless you want GC as principal applicant only

    I am not sure if your answering the question on this post..

    Husband and wife can be on thier application as principal and dependant applicants on each other's application from their respective company
